Pingo — Privacy Policy

This Privacy Policy explains what information Pingo Entertainment, Inc ("Pingo," "we," "us") collects when you use the Pingo website and apps (the "Services"), how we use it, and your choices. It is incorporated into our Terms of Service.
1. Information We Collect
1.1 Information You Provide
- Account information: your email address, a username and password, and your confirmation that you are 18 or older. You may also choose to add a display name.
- Communications: the contents of messages you send us (support requests, emails, feedback) and related metadata.
We do not collect payment or financial information, government identifiers (such as a Social Security number), government-issued identification, or tax information — the Services are free and do not involve payments.
1.2 Information We Collect Automatically
- Device and usage information: IP address, device and browser type, operating system, app version, and information about how you interact with the Services (screens viewed, actions taken, and timestamps).
- Error and performance diagnostics: when something fails or behaves unexpectedly, we collect technical diagnostics — the type of error, a stack trace, the screen where it occurred, an anonymous user identifier, device information, and a record of the recent technical events that led to the failure — to diagnose and fix problems. We do not include your email address in these diagnostics.
- Product-usage events: we collect events describing how you use the Services — for example, that you built a board, made your picks, shared a board, or sent a friend request — together with an anonymous user identifier, the screen where the event occurred, the sport involved, and your approximate region (country and region, derived from your IP address). We use these to understand which features are used and to improve the Services. We do not include your email address in these events.
- Advertising-measurement data: when we are running advertising and you reach Pingo from an advertisement, we collect the fact that you arrived from a campaign (the campaign identifiers on the link you followed), together with an anonymous identifier and the page or screen where it happened, and, where an advertising pixel is in use, we share these with the advertising platform that showed you the ad (currently Meta) so we can measure whether our advertising works. We do not include your name, email address, or account details in this data. See Section 3 for how to opt out.
- Cookies and similar technologies: as described in Section 3.
2. How We Use Information
We use the information we collect to: create and manage your account; operate the game and determine results; provide customer support and respond to your requests; send you administrative and transactional messages about your account and the Services; send marketing communications where permitted (you can opt out — see Section 8); monitor the reliability and performance of the Services, diagnose and fix errors, and measure feature usage to improve the Services; keep the Services secure and prevent abuse; and as otherwise described to you or with your consent.
3. Cookies and Similar Technologies
We use cookies and similar technologies to keep you logged in, remember your preferences, keep the Services secure, and understand how the Services are used so we can improve them. You can control cookies through your browser settings; disabling some may impair the Services. The technologies we use today are limited to authentication, security, product-analytics, and advertising-measurement technologies. If we run advertising, we use advertising-measurement pixels provided by the advertising platform (currently Meta) on our marketing website, so we can understand which advertisements bring people to Pingo and measure how those campaigns perform. We do not use session-recording or session-replay technologies. If our use of these technologies materially changes, we will update this Policy and provide any opt-out or consent mechanisms required by law first.
4. How We Share Information
We do not sell your personal information. We share information only as described here:
- Service providers who process information on our behalf and are contractually limited to that purpose. Our current providers are: Supabase (database and authentication); Firebase and Google Cloud (hosting and infrastructure); Sentry (error and performance monitoring — receives only the diagnostics described in Section 1.2); PostHog (product analytics — receives only the product-usage events described in Section 1.2); and, when we are running advertising, Meta (advertising measurement — receives only the advertising-measurement events described in Section 1.2 and this Section, never your name, email address, or account details). We may add or change providers over time and will update this list when we do.
- Legal, safety, and compliance: to comply with applicable law, regulation, or legal process; to enforce our Terms; and to detect, prevent, or address fraud, security, or technical issues, or to protect the rights, property, or safety of Pingo, our users, or others.
- Corporate transactions: in connection with a merger, acquisition, financing, reorganization, sale of assets, or similar transaction (including the contemplated transfer of the Pingo business to an affiliated entity), in which case information may be transferred as a business asset, subject to this Policy.
- Affiliates, consistent with this Policy, and with your consent or at your direction.
We may use and share aggregated or de-identified information, which cannot reasonably be used to identify you, for any lawful purpose.
5. No Sale of Information; Advertising Measurement and Your Choices
Pingo does not sell your personal information for money. When we advertise Pingo, we use advertising-measurement pixels (currently Meta) to measure whether those advertisements work and to reach people who may be interested in the game. Under some state privacy laws, this use may be treated as “sharing” personal information for cross-context behavioral advertising, and we describe it that way so you can make an informed choice. You can opt out at any time by emailing privacy@playpingo.com, by using the advertising controls in your browser or device settings, or by using the ad-preference settings offered by the advertising platform itself.
We do not serve third-party advertising inside the Services — you will not see other companies’ ads while playing. Our analytics and error-monitoring providers (PostHog and Sentry) receive information only to operate and improve the Services on our behalf and are contractually prohibited from using it for their own advertising. If any of this changes, we will update this Policy and provide the opt-out mechanisms required by law first.
6. Leaderboards and Results
The Services display standings and leaderboards showing how players finished, identified by your username or display name. If you connect with friends, they may see your username and results. You control your display name in your account settings.
7. Data Retention
We keep personal information for as long as needed to provide the Services and for legitimate business and legal purposes — including maintaining your account, resolving disputes, and enforcing our agreements. When information is no longer needed, we delete or de-identify it. If you close your account, we will delete or de-identify your information within a reasonable period, except where retention is required by law.
8. Security
We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. You are responsible for keeping your login credentials confidential. If you believe your account has been compromised, contact us at privacy@playpingo.com immediately.
9. Children
The Services are intended only for individuals 18 years of age or older. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from someone under 18, we will delete it. If you believe a minor has provided us information, contact us at privacy@playpingo.com.
10. Your Privacy Choices and Rights
You can review and update your account information in your account settings, and opt out of marketing emails using the unsubscribe link in those messages (we may still send transactional messages about your account).
Depending on your state of residence, you may have rights regarding the personal information we hold about you — including to confirm and access it, correct it, delete it, obtain a portable copy, and opt out of any sale or sharing for targeted advertising or certain profiling (we do not sell personal information; see Section 5 for our use of advertising measurement and how to opt out). To exercise a right, contact us at privacy@playpingo.com. We will verify your identity before responding, typically by confirming information associated with your account, and will respond within the timeframes required by applicable law. You may use an authorized agent, and you may appeal a denied request by contacting us at the same address. Where required by law, we treat recognized opt-out preference signals (such as Global Privacy Control) as valid opt-out requests.
11. Third-Party Links
The Services may contain links to third-party websites or services we do not control. This Policy does not apply to them, and we are not responsible for their practices. Review their privacy policies before providing information.
12. Changes to This Policy
We may update this Policy from time to time. The current version, with its version number and date, will always be available within the Services. If we make material changes, we will use commercially reasonable efforts to notify active Users.
